By placing your
order you accept the following Terms and Conditions:
1.
Pricing
Our products
and prices are subject to change. Promotional terms only apply in
the period stated for the promotion. Whilst we will try to ensure
that all our advertised prices are accurate, we are not responsible
for errors that may occur. If we discover any errors in the price of
goods before we accept your order, we will notify you as soon as
possible and give you the option to resubmit your order at the
correct price or cancel the order. The price of all goods and
services advertised are exclusive of any applicable taxes including
VAT.
2. Availability
All
goods and services are subject to availability. We endeavour to give
approximate availability of our products when requested.
3. Delivery
Charges for delivery are not included in the stated product price -
see Delivery for details of applicable charges. Delivery can be made
anywhere in the world at a fixed price agreed in advance.
4. Ordering
NextCom Europe
accept faxed or electronic orders providing they contain a signature
of authorization and contain the company header. NextCom Europe will
issue either a faxed or electronic acknowledgement for every order
placed if requested. All orders are subject to approval by us. When
processing your order, the information provided will be subject to
credit and fraud prevention checks. For these purposes we may
transfer your information to trusted third parties.
5. Payment
Payment terms
are typically prepayment for first order with subsequent orders
being Net 30 days from date of Invoice. 30 day terms are subject to
credit approval and are ultimately at the discretion of NextCom
Europe.
6. Returns and
Refunds
If the goods
are damaged or faulty on arrival and NextCom Europe are notified of
this within 7 days, then a replacement unit will be shipped to the
customer. The damaged or faulty unit must be returned to NextCom
Europe who will reimburse the customer for any shipping costs
incurred. If the unit fails after 7 days from delivery then it must
be returned to NextCom Europe for a warranty repair, or replacement
at NextCom Europe's discretion. The customer will be liable for the
shipping costs back to NextCom Europe in this instance. If the unit
is returned for any other reason and is still in mint condition, the
customer will qualify for a refund less a 25% re-stocking fee and
all delivery charges.
7. Website
Information
Any
goods, services or information displayed on the NextCom Europe
website should not be regarded as an offer, invitation,
solicitation, advice or recommendation to buy products or services
on the website. No warranties or representations are made about any
goods other than as expressly contained in this Website. To the
extent permissible by law all implied terms, whether by statute or
otherwise, are excluded.
8. Liability
NextCom Europe’s liability for any injury (other than
death or personal injury), damage or loss, in particular
consequential loss, arising from the use of any goods purchased via
from NextCom Europe, or from the transaction itself, are hereby
excluded. Any injury, damage or loss arising directly from the
negligence of NextCom Europe or any of its agents will be limited to
a refund of the value of the goods purchased, together with any
delivery charges paid.
9. Security
While all
reasonable care is taken to protect the confidentiality of your
credit card details NextCom Europe cannot be liable if, through no
fault of its own, these details are intercepted by and used by third
parties. All personal details are handled in accordance with the
Data Protection Act 1998.
